Child Custody & Divorce
Family law is the most emotional legal practice area. Mark brings a caring, personable and empathetic approach to every case.
Without a doubt, family law is the most emotional legal practice area. Mark Marsh represents clients in both contested and non-contested divorces as well as child custody and support cases. Mark has built a reputation for legal counsel with a caring, personable and, most importantly, empathetic approach to divorce cases.
Even if a divorce starts out contested, Mark works to get the vast majority of his cases finalized as uncontested — saving time and money. This is largely due to his solid reputation in the legal community, his integrity and his ability to negotiate effectively with other attorneys.
Contested divorce — spouses cannot agree on one or more key issues. Requires court appearances, can take nine to 13 months and cost tens of thousands of dollars.
Uncontested divorce — often called a “quick divorce”; spouses agree on all issues, requiring a fraction of the legal involvement and finalizing as soon as an agreement is signed by a judge.
Custody and visitation can be the most emotional aspect of a divorce. The best interest of the children is always at the forefront, and Mark works tirelessly to achieve the best possible agreement for you and your children.
In 2017, the Nevada Revised Statutes were amended to favor joint custody as the preferred outcome — protecting parental rights without penalizing the primary income earner.
Joint custody is only the starting point. If an alternative better serves your child’s physical and emotional well-being, Mark will file a petition to modify the custody arrangement.
Spousal support & pre/postnuptial agreements
As a seasoned divorce attorney, Mark will review your case and determine the appropriate spousal support, considering factors such as age, income, education, skills, expenses, standards of living, child custody and medical conditions.
Pre and postnuptial agreements must be entered into voluntarily by both parties and deemed fair by your legal representative — and should always be prepared or reviewed by an attorney before signing. Mark has been helping clients draft these agreements over the duration of his legal career.
